On January 1, Washington will see a radical change to Non-Compete contract provisions, covering all employees and independent contractors working in Washington. HB 1450 not only limits who is subject to non-compete language, but how and for how long. And this is not just for new contracts - there is no ‘free pass’ for your current employment contracts!

The law fines employers for attorney fees and costs, along with a statutory $5,000 fine for contracts that do not comport with the new provisions - no more ‘reasonableness’ standards. Many employees will now be able to ‘moonlight’ with competing businesses, or even open up their own business.


Employees earning over $100,000/yr (or $250,000 for Independent Contractors) can be subject to non-compete restrictions...but only if these restrictions are carefully drafted under the new statute.


You may still enforce certain non-compete agreements, non-solicitation agreements and trade secret protection and limit your exposure to statutory penalties, but only if your contracts are redrafted according to the new requirements.
